Stress at work

What is it?

It's difficult to define stress as such, as it can mean different things to different people. The (Health and Safety Executive) HSE's definition of stress is “the adverse reaction a person has to excessive pressure or other types of demand placed upon them”.

It can obviously take different complex forms, but the key issue is that the employer's behaviour must be extreme. That is why stress claims need to be explored with a professional for your claim to be a success and for you to win your case.

Unfair Dismissal / Constructive Dismissal claims

What is Constructive Dismissal?

An employee may be entitled to resign if their employer breaches a fundamental term of their employment contract. This is known as constructive dismissal.

Breaches of contract that may give rise to unfair constructive dismissal claims might include anything which makes it impossible or intolerable for you, the employee, to continue doing your job.

Examples may include:

  • unilaterally cutting - or trying to cut - an employee's wages or salary or other contractual benefits
  • transferring an employee to a different job or location in the absence of any stated or implied contractual right to do so
  • failing to provide a safe place of work
  • breach of the obligation of mutual trust and confidence implied in every employment contract

For this reason your employer should always seek your prior written agreement when proposing to change your employment contract.

Maternity Issues?

A woman will automatically be regarded as having been unfairly dismissed if her employer dismisses her, or selects her for redundancy, because she is pregnant or has given birth to a child, or for a reason connected with her pregnancy or childbirth.

If a woman is made redundant during her ordinary or additional maternity leave period, she should be entitled to a redundancy payment.

Of course, employees have the right not to be subjected to detrimental treatment on the grounds of maternity, pregnancy, childbirth.
